These Terms and Conditions govern your access to and use of the Incometra Loan Income Audit Platform. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Section 1

Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for use by licensed mortgage brokers, financial advisers, and their authorised staff operating within Australia.

Section 2

Account Registration

You must create an account to access the Service. You agree to:

  • •Provide accurate, current, and complete information during registration and keep it up to date
  • •Maintain the confidentiality of your account credentials
  • •Accept responsibility for all activities that occur under your account
  • •Notify us immediately at [email protected] of any unauthorised use of your account

Subscription and Fees

Access to the full features of the Service requires a paid subscription. We offer three paid subscription tiers:

  • •Starter — $14.99 AUD/month, 10 audits/month
  • •Pro — $39.99 AUD/month, 30 audits/month
  • •Enterprise — $199.99 AUD/month, 200 audits/month
  • •Paid subscribers may also purchase additional audit credits at any time
  • •New users receive a free trial upon registration

ℹ Note: Subscription fees are billed in advance and are non-refundable except as required by Australian Consumer Law. We reserve the right to modify pricing with 30 days' written notice.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:

  • •Process documents belonging to individuals without their consent
  • •Attempt to gain unauthorised access to any part of the Service
  • •Upload malicious files, viruses, or harmful code
  • •Reverse-engineer, decompile, or disassemble any part of the Service
  • •Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users' access

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Incometra. Our trademarks and trade dress may not be used without our prior written consent.

  • •By uploading documents you grant us a limited, non-exclusive licence to process them for the purpose of providing the Service

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

  • •You are solely responsible for verifying the accuracy of any extracted data before submitting it to a lender

Limitation of Liability

To the fullest extent permitted by applicable law, Incometra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

ℹ Note: Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Section 8

Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

  • •Upon termination, your right to use the Service will immediately cease
  • •You may cancel your subscription at any time through your account settings
  • •Cancellation will take effect at the end of the current billing period

Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Section 10

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.

Section 11

Your Privacy Rights (APP 12 & APP 13)

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the following rights with respect to personal information held by Incometra. These rights apply to all registered users of the Service:

  • •Access — you may request a copy of the personal information we hold about you by contacting [email protected] with the subject line 'Data Access Request'. We will acknowledge your request within 5 business days and respond in full within 30 days.
  • •Correction — if any personal information we hold is inaccurate, incomplete, or out of date, contact [email protected] with the subject line 'Correction Request'. We will correct or annotate the record within 30 days and notify you of the outcome.
  • •Deletion — you may request immediate deletion of all your personal data (including uploaded documents, audit sessions, and extracted data) via Profile > Data Erasure Request within the Service. This action is permanent and irreversible. Alternatively, contact [email protected] with the subject line 'Erasure Request'.
  • •Portability — you may export your audit results and session history at any time from within the Service.
  • •Complaint — if you are not satisfied with how we have handled your personal information, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

ℹ Note: We will respond to access and correction requests within 30 days as required by the Privacy Act 1988. In exceptional circumstances, we may extend this period to 60 days with written notice.
